Privacy

Controller

The controller for the processing of personal data in connection with this website is Mosima, reachable at baseshape.dev@gmail.com.

BaseShape is operated from Switzerland; the Swiss Federal Act on Data Protection (FADP) applies. Where the EU General Data Protection Regulation (GDPR) applies, the information on legal bases and rights further below also applies.

This website

The website sets no cookies, uses no analytics or advertising services and loads no fonts or scripts from third-party servers.

Hosting

The website is served by Cloudflare Pages (Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA). When the website is requested, Cloudflare technically receives the connection data that arises with every request on the internet, in particular the IP address, the time, the requested address and the browser identifier.

The purpose is to deliver the website and operate it securely. Cloudflare runs data centres in many countries; the data may also be processed in the USA.

YouTube

The preview image of the promo video is stored on this website. The video itself is only loaded when you click “Play video”. Only then does your browser connect to YouTube (youtube-nocookie.com), and YouTube receives data such as your IP address. For users in Switzerland and the EEA the provider is Google Ireland Limited; data may also be transferred to Google LLC in the USA. From the click onwards, Google's privacy policy applies.

The link “Open on YouTube instead” leads to YouTube; Google's privacy policy also applies there.

Download via GitHub

The BaseShape program file is provided via GitHub Releases (GitHub, Inc., 88 Colin P. Kelly Jr. St., San Francisco, CA 94107, USA). When you click “Download BaseShape”, your browser downloads the file directly from GitHub; GitHub receives the usual connection data such as your IP address. The purpose is to provide the program file. GitHub's privacy statement applies to this processing.

Contact form

The contact form uses the service FormSubmit (formsubmit.co). When you send the form, your browser connects to FormSubmit and transmits the topic, your name (if given), your email address and your message; FormSubmit forwards them by email to baseshape.dev@gmail.com. FormSubmit technically also receives your IP address. The purpose is to answer your enquiry.

According to FormSubmit, submitted messages are retained for 30 days. This storage takes place at the external form provider, not on the BaseShape web server.

FormSubmit does not state an operating company, registered office or server location on its website; it gives support@formsubmit.co as its contact. Processing outside Switzerland, including in a country without adequate data protection, therefore cannot be ruled out. If you do not want this, write an email directly instead.

The website itself does not store the data and sets no cookies for it. No captcha service is embedded.

Email

If you write an email to baseshape.dev@gmail.com or use the form, Mosima receives your email address and the content of your message. The mailbox is hosted by Gmail; for users in Switzerland the provider is Google Ireland Limited. Google processes data on servers in many countries, including the USA.

Update check of the desktop app

If “Check for Updates Automatically” is switched on in BaseShape (the default), the program requests the file https://baseshape.pages.dev/release.json from this website about 20 seconds after start-up, at most once within 24 hours. You can also check by hand at any time via “Help → Check for Updates”.

BaseShape sends a simple HTTPS request with the program identifier “BaseShape” (user agent). It contains no information on the program, Windows or any other software version. No cookies, no query parameters and no user, installation or device identifier are transmitted. As with every connection on the internet, Cloudflare technically receives your IP address and the time of the request.

The file only states the currently published version and the download page. Nothing is downloaded or installed automatically. The purpose is to notify you of a new version. The automatic check can be switched off in the settings.

Disclosure abroad

According to their own statements, Cloudflare, GitHub and Google LLC participate in the Swiss-U.S. Data Privacy Framework. For companies in the USA certified under it, the Swiss Federal Council has recognised an adequate level of data protection. No such information is available for FormSubmit (see “Contact form”).

Legal bases under the GDPR

Where the GDPR applies, the processing is based on the following: delivering the website, the download and the update check on the legitimate interest in a secure and working service (Art. 6(1)(f) GDPR); loading the video on your consent given by the click (Art. 6(1)(a) GDPR); contact enquiries on answering your enquiry (Art. 6(1)(b) and (f) GDPR).

Storage period

Connection data at Cloudflare, GitHub and YouTube: how long these providers keep the data is governed by their own privacy policies.

Contact form: according to FormSubmit, messages are retained for 30 days. Emails and form messages in the mailbox are deleted once the enquiry has been dealt with and there is no obligation to keep them.

The website itself stores no personal data.

Your rights

Under the FADP you can request information on whether and which personal data about you is processed, request the handover or transfer of your data, the correction of incorrect data and the deletion of your data, and object to the processing. Where the GDPR applies, you also have the right to restriction of processing and can withdraw consent at any time with effect for the future.

To do so, write to baseshape.dev@gmail.com. You can also contact the Federal Data Protection and Information Commissioner (FDPIC); where the GDPR applies, also a data protection supervisory authority in the EU.

For data that Cloudflare, GitHub, Google or FormSubmit process under their own responsibility, you can also contact these providers directly.
